By accessing or using CarPixels ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, you must not use the Service.
2. Service Description
CarPixels is an AI-powered platform that generates, transforms, and animates images and videos of vehicles. All outputs are algorithmically generated and may vary in quality, accuracy, and realism. The Service is provided for entertainment, creative, and illustrative purposes.
3. Eligibility and Accounts
You must be at least 18 years old to use the Service. By registering, you represent that you meet this age requirement.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy (incorporated into these Terms by reference) to understand how we collect, use, and protect your personal information and uploaded content. The Privacy Policy explains your rights under applicable laws, including POPIA (South Africa).
5. Credits, Subscriptions and Billing
The Service uses a credit-based system. Credits are deducted for each generation or feature usage.
Subscription plans provide a fixed monthly credit allocation that does not roll over.
Prepaid credits are valid for 12 months from the date of purchase.
All payments are processed via secure third-party providers.
We reserve the right to change pricing with at least 30 days' notice.
6. Payments and Refunds
Subscription fees are billed in advance on a recurring monthly or annual basis. All payments are non-refundable except where required by applicable law. Failed payments may result in suspension of your account until payment is resolved.
7. Intellectual Property
a. Our IP All technology, AI models, interfaces, logos, trademarks, and underlying code of CarPixels are the exclusive property of My3Ideas / CarPixels. You are granted a limited, revocable, non-exclusive licence to use the Service during your subscription.
b. Generated Content You retain ownership of the images and videos you generate. CarPixels grants you a worldwide, royalty-free licence to use, modify, and commercially exploit the generated outputs, subject to these Terms and your compliance with applicable laws.
c. Uploaded Content By uploading images or references, you grant CarPixels a limited, non-exclusive, royalty-free licence to process, analyse, and use those images solely to provide the requested service. You represent and warrant that you own or have all necessary rights to upload any content and that it does not infringe third-party rights.
8. Trademarks and Brand Accuracy
Generated images may contain vehicle trademarks, badges, or designs. CarPixels makes no representations or warranties regarding your right to use such trademarks commercially. You are solely responsible for ensuring that your use of generated content complies with all applicable trademark, copyright, and advertising laws.
9. Prohibited Conduct
You may not use the Service to:
Generate content that is illegal, harmful, defamatory, hateful, or pornographic.
Create misleading or fraudulent representations of vehicle condition for sales purposes.
Infringe or misappropriate intellectual property rights.
Reverse-engineer, decompile, or attempt to extract the underlying AI models.
Circumvent credit limits, security measures, or rate limits.
Use the Service for bulk automated generation intended to compete with CarPixels.
10. Termination and Suspension
We may suspend or terminate your account at any time, with or without notice, for violation of these Terms, non-payment, or any other reason we deem necessary. Upon termination, your right to use the Service ceases immediately, but you retain ownership of previously generated content (subject to these Terms).
11. Disclaimers and No Warranties
The Service is provided "as is" and "as available" without any warranties, express or implied. We do not warrant that generated images will be accurate, error-free, or suitable for any purpose, or that the Service will be uninterrupted or secure. AI outputs are artistic interpretations and may contain inaccuracies in vehicle models, colours, proportions, badging, or features.
12. Limitation of Liability
To the maximum extent permitted by law, CarPixels and My3Ideas shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you shall not exceed the total amount you paid to us in the three (3) months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless CarPixels, My3Ideas, and our affiliates, officers, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your uploaded content, your generated outputs, or any breach of these Terms.
14. Modifications to Terms
We may update these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use of the Service after the updated Terms are posted constitutes your acceptance of the changes.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
